Singer Botir Kadyrov has once again been fined for the unauthorized use of a poem by poet Shamsiddin Turayev, known by the pseudonym “Shamsiddin Sadoiy.” The press service of the Ministry of Justice reported the incident.
According to reports, in June of this year, poet Shamsiddin Turayev filed a lawsuit with the Uchtepa Interdistrict Civil Court to stop the copyright infringement. The lawsuit sought compensation for moral damages and for the violation of his copyright.
The civil case was reviewed, and based on the court’s decision, the defendant Botir Kadyrov was ordered to pay 300 times the base calculation amount—equivalent to 112.5 million soums—in compensation, as well as 20 million soums in moral damages to the plaintiff, Shamsiddin Kho’jayevich Turayev.
Additionally, the court ordered Botir Kadyrov to immediately cease (strictly prohibit) the broadcasting of the songs “Davlating borida,” “Omonat,” and “Tingla do‘stim,” which were authored by the plaintiff. The order also prohibits Kadyrov from publishing or using these songs in any form on state or non-state television and radio channels, social networks, or any other platforms throughout the Republic of Uzbekistan.
For reference, under Uzbekistan’s copyright legislation, the author has the right to demand compensation ranging from 20 to 1,000 times the base calculation amount for violations.
It is worth noting that Botir Kadyrov was previously fined 1 million 875 thousand soums for the unauthorized use of poems by “Shamsiddin Sadoiy.” He was also fined 3 million soums for the unpermitted use of the poems “Qizg‘onaman,” “So‘nggi nafsgacha,” “Sog‘indim yomon,” and “Dildora” by poet Shohrukh Abduvohidov, who writes under the pseudonym “Abdussamiy.”
