Registration fees for arbitrarily acquired land plots were announced

On August 5, President Shavkat Mirziyoyev signed a law titled "On Recognition of Rights to Arbitrarily Occupied Land Plots and Buildings and Structures Built on Them," which, starting November 8, will allow ownership of arbitrarily acquired land plots to be legally granted. UzA reported on the details of the registration fees, citing Izzatulla Rahimov, head of the State Registration of Rights to Real Estate at the Chamber of State Cadastres.
The law provides a framework for recognizing rights to land plots and the buildings on them. If approved by the Ministry of Justice in the Republic of Karakalpakstan, regional, or Tashkent Justice Departments, the Cadastre Agency will issue a one-time payment notification to individuals via an automated system within twenty business days.
For citizens of Uzbekistan and stateless persons residing permanently in the country who have built homes on such plots before May 1, 2018, a one-time fee will apply to register both the land and any structures on it.
Ownership rights to self-built, single-family homes will be established by district or city commissions organized to recognize property rights. These commissions are formed based on decisions from Uzbekistan’s Cabinet of Ministers. If property recognition is possible or if recognition is denied or delayed due to time limits of the one-time public action, a one-time fee will still be required.
Additionally, the following one-time fees will apply for land plots occupied by residences in horticultural and viticultural societies, privatized buildings, or those occupied by citizens, individual entrepreneurs, and legally recognized entities:
- Tashkent City: Five times the base calculation amount;
- Nukus and Regional Centers: Three times the base calculation amount;
- Other Cities: Twice the base calculation amount;
- Other Settlements: Equal to the base calculation amount.
Certain individuals are exempt from this fee, including:
- those who paid the full fee during the one-time state campaign and individuals with group I and II disabilities;
- those registered in the "Unified Register of Social Protection" will only be charged 50% of the set fee.
If the district or city commission, as part of the state campaign, deems property rights for arbitrarily built buildings and structures eligible for recognition but has not collected the full one-time fee, the remaining fee will still be required under this law.
The one-time fee paid under the national campaign and any additional charges under this law are non-refundable.
The average market value for lease rights, based on land use purposes, is determined twice yearly by the State Asset Management Agency. These values, calculated for 0.01 hectares, are published on the agency’s website and are incorporated into the automated system. For areas lacking electronic auctions, average district or city prices serve as a basis, adjusted for lease term.
If fees are not paid within the specified timeframe, the recognition process for the land rights will be suspended. Once payment is complete, the collected documents and supporting conclusions will be automatically submitted to the Dzhokorgi Council of Karakalpakstan or respective People’s Deputies’ Councils for review in their next session.
